Gracias a FEARLESS puedo dirigirme a un selecto público al que espero, al menos, no aburrir con las tres manifestaciones Mondo Difficile que traigo a estas páginas este trimestre. Por lo menos, la dificultad de explicarlas desde la lógica y el sentido común. En el mundo del Derecho es imprescindible la cita del maestro Recasens Siches que cifra la condensación del Derecho en el logos de lo razonable. Y en ese mundo de la razonabilidad deberían discurrir las públicas y voluntarias manifestaciones de palabra y de obra de nuestros representantes públicos, con el debido respeto a la libertad de expresión y a la libertad de hacer el ridículo voluntariamente. Y de este jaez puede calificarse la primera de ellas.

Me refiero a la opinión públicamente expresada por la ex ministra socialista de Vivienda María Antonia Trujillo Rincón en Tetuán. “La reivindicación de Marruecos sobre Ceuta y Melilla está justificada”. No sabemos en qué derecho funda la justificación María Antonia, como tampoco lo saben los socialistas de Melilla cuya portavoz Gloria Rojas, ha afirmado que “ningún socialista está de acuerdo con las declaraciones de la exministra”. La Asamblea de Melilla ha acordado por unanimidad en Pleno Extraordinario declarar persona non grata a la ex ministra “por sus declaraciones, en las que cuestiona la soberanía de nuestras ciudades, asunto que está fuera de toda duda”. Y es que más allá del desconocimiento de la singularidad histórica de estas dos ciudades, semejantes declaraciones suponen un ataque a la letra de la Constitución española de 1978 y a los Estatutos de Autonomía de las mismas. Algunos medios han deslizado la vinculación de María Antonia con Marruecos vía sentimental. Lo cierto es que es tan libre de expresarse de tal manera en público como de hacer el ridículo voluntariamente. La actualidad de Melilla puede estar jalonada de dificultades relacionadas con el control migratorio y de todo tipo, pero ello no obsta sino más bien lo contrario, a discutir su españolidad, ya no sólo desde 1497 con su toma por parte de Castilla, en la expedición de Juan Alonso de Guzmán, duque de Medina Sidonia, sino porque ninguna otra soberanía anterior, a salvo su pertenencia a la provincia hispano romana tingitana se ha registrado a lo largo de los siglos. Se desconoce, de paso, por Maria Antonia el esfuerzo que esta ciudad llevó a cabo en todo momento por defender dicha españolidad a lo largo de la historia, por fuera del resto del Protectorado español en el siglo XIX. Ni qué decir tiene que otro tanto de lo mismo sucede con Ceuta. El PSOE de esta ciudad mostró su total rechazo y su líder calificó estas declaraciones de muy desafortunadas e inadmisibles. La Historia nunca puede abonar una pretendida soberanía sobre Ceuta de un inexistente Marruecos antes del S.XX y tamaña realidad es enciclopédicamente desconocida por María Antonia, cuya ignorancia y su carácter de exministra, en plena crisis con Argelia, convierten sus declaraciones en una suerte de traición a la Constitución española y a España. Enhorabuena Maria Antonia. Concluimos con palabras de un ex Ministro de Asuntos Exteriores del Reino de España: Melilla hace más de 525 años que es España, 18 años antes de que Navarra se incorporara a la Corona de Castilla, 162 años antes de que el Rosellón fuera francés y 279 antes de que existieran los Estados Unidos. Las raíces de España como unidad política quedan muy perfiladas y, para siempre, con la conquista por Roma y su delimitación provincial en la que se integra la denominada Hispania Transfretana a partir del S.IV, naturalmente con Ceuta y Melilla, amén de Orán, Argel y Túnez, por poner algunos ejemplos. Esa estructura será la que a lo largo de los siglos, con la superposición de la Iglesia a partir del S. IV, incluso tras la caída del Imperio, se mantendrá para siempre.

Pero volvamos al Mondo Difficile, que da título a esta serie de FEARLESS®. Una de las disfunciones del sistema de justicia criminal, en particular del español, lo constituye la rectificación y revisión de los errores judiciales. Las garantías penales en un avanzado Estado de Derecho pasan por dotarse de mecanismos legales eficaces para la depuración de los mismos, incluso por fuera del régimen ordinario de recursos. Y en este sentido conviene replantearnos en nuestro sistema procesal el recurso de revisión, cuyos estrechísimos márgenes dejan fuera de su perímetro de actuación numerosos y clamorosos errores judiciales. Conviene subrayar que es tema de tratamiento universal en literatura o cinematografía. (Veánse las clásicas Matar a un ruiseñor de Robert Mulligan, En el nombre del padre de Sheridan o Anatomía de un asesinato de Otto Preminger, entre otras). Es un tema que como penalista siempre me ha preocupado y sobre el que volveré. Resulta interesante, para un lacerante ejemplo de error judicial, la lectura de la obra Justicia poética, de Braulio García Jaén publicada en Seix Barral con el subtítulo de “El caso de dos condenados por la cara”. El error judicial lo firma como ponente de la sentencia judicial de la Audiencia Provincial de Barcelona, la ministra Robles. Las víctimas del mencionado error fueron Ahmed Tommouhi y Mounib, dos inmigrantes marroquíes en Cataluña empleados en la albañilería. El primero pasó quince años en prisión y Mounib murió de un infarto en la cárcel en el año 2000. Lo refiere Mónica Ceberio en el diario El País de 28 de marzo de 2010, párrafo 11: “la Audiencia de Barcelona no tuvo en cuenta en una de las condenas, de la que fue ponente la vocal del Consejo General del Poder Judicial Margarita Robles, que en un análisis de semen excluía la autoría de Ahmed. Los jueces no entendieron el informe”.
Jesús García de las Bayonas Delgado reproduce la conversación entre Braulio García Jaén y Margarita Robles, extraída de la página 252 del libro arriba citado, de la que me permito entresacar lo siguiente: “ (M.R).- La verdad, me parece absurdo hablar sobre un caso que pasó hace tantos años. Porque si Ud. me dice que se acuerda de un artículo de hace 14 años, yo es que no me lo creo, sinceramente, es absurdo.”
Me quiero detener en esta respuesta porque entiendo que una respuesta de este tipo resulta inaceptable. Sobre todo cuando se ha producido una condena que en su cumplimiento ha comportado ver la muerte en prisión de un inocente y, en todo caso, la usurpación de la vida en libertad durante tres y quince años de ambos condenados respectivamente. Ambos emigrantes marroquíes, albañiles y analfabetos; gente que viene a España a trabajar y cuyo único pecado, en este caso, es parecerse al auténtico violador. Termina la entrevista cuando la actual ministra afirmaba tras la observación de que una persona sigue en la cárcel que “ese no es mi problema … si esa persona está en la cárcel y yo dicté una sentencia, será porque se ajustaba a Derecho. Y si no, para eso está el Supremo. Así que…”. Sin comentarios. Hay que presumir entonces, sin posible prueba en contrario, que es ajustada a Derecho, “así que…”. Así de infalible es esta mujer. “Ese no es su problema”. En fin…
En 1997 se demostró la inocencia de estos hombres porque las pruebas de ADN probaron que Antonio García Carbonell había sido el responsable de la violación por la que se condenó a estos dos inocentes en uno de los casos. En el resto de condenas y, a pesar de la evidencia de su inocencia, nada se pudo hacer por los estrechos márgenes de nuestro recurso de revisión. Así se pudo corroborar gracias a la previa labor, esta sí, muy honrada, de un Guardia Civil y un Ingeniero que abrió una web sobre el caso. “Así que..” En fin… Mondo Difficile.

Otras manifestaciones de este Mondo Difficile son las operaciones policiales estrella, con intrépidos y mediáticos investigadores policiales, y sus correspondientes superiores judiciales, excepcionalmente también intrépidos y mediáticos, generando macroinstrucciones con seriales periodísticos acaparando portadas con decenas, incluso centenares, de víctimas inocentes cuya reputación, honor y, en algunos casos, inocencia quedarán de por vida laminadas. Me refiero esta vez, y lo hago a propósito de mi participación como alumno en el muy sobresaliente curso de verano de la UIMP en la primera semana de septiembre sobre lucha antidopaje, organizado por el CELAD (Comité Español para la Lucha Antidopaje en el Deporte), por cierto heredero de la AEPSAD (Agencia Española para la Salud en el Deporte) que yo dirigí durante un breve espacio de tiempo y hoy dirigido por José Luis Terreros, un excelente científico dedicado toda su vida a la medicina deportiva. En el mencionado Seminario, sobre todo, se ha tratado de la nueva ley en la materia, LO 11/2021, de 28 de diciembre, de Lucha Antidopaje en el Deporte, aprobada por unanimidad en las Cortes y que supone un importante avance en esta materia, así como la posibilidad de responder internacionalmente a los requerimientos de integridad en la lucha contra el dopaje en el deporte español. El elenco de ponentes es revelador de la altura del seminario y, como partícipe a título de alumno, debo felicitar a la CELAD.
Pero en alguna mesa se habló de las decepciones procesales que en el pasado en este Mondo Difficile se habían producido. Como, por poner algún ejemplo, fueron las operaciones “Puerto” y “Galgo”. Fueron tan cacareadas y anunciadas a bombo y platillo para descrédito de quienes, al menos formalmente, resultaron ser inocentes como inanes en punto a la investigación del dopaje en el mundo del ciclismo y del atletismo. Nunca recuperarán enteramente su
honor las víctimas de las filtraciones y espúreas imputaciones desde una perspectiva procesal, pero no me quiero fijar tan solo en este caso en las víctimas, sino sobre todo en la ignorancia, inepcia, aversión al Derecho o acaso todas ellas, vaya usted a saber, de los líderes de las citadas instrucciones. Sencillamente una vergüenza. Sobre todo cuando la Audiencia Provincial tiene que recordar que se ha producido una instrucción sin delito previo por impunidad de los hechos imputados o porque existen violaciones de derechos fundamentales en la instrucción. Y si existió dopaje, realmente, desde el punto de vista del hecho probado no pudo afirmarse nunca. Frustrante a la vez

Por último y por fuera de las censuras a las que este Mondo Difficile nos aboca debo decir que la Sección de Derecho de la Tauromaquia del ICAM ha estado presente en el prestigioso Congreso organizado por el Instituto Internacional de Derecho de la Tauromaquia de Nimes con la presencia del excepcional filósofo y maestro Francis Wolff autor de numerosas obras que aconsejo a los lectores de FEARLESS® -revista que no se pronuncia ni a favor ni encontra de la tauromaquia- , incluso a los menos taurinos.
